VII. Preparing for the Hearing

There is much preparation that must be done prior to an administrative hearing. The type and amount of preparation involved depend on the facts of the case and discovery obtained from the DRE. Many license • applicants and licensees mistakenly believe that they need only show up at an administrative hearing and tell their side of the case. Many license applicants and licensees are led to believe that the hearing is informal and effective legal representation is not required. The failure to properly prepare for a hearing by license applicants and licensees usually results in the DRE obtaining the maximum discipline the DRE is seeking. An experienced attorney dealing with a DRE case always obtains the complete DRE files and provides instructions to you as to what evidence or the types of evidence that will be needed at the hearing.
